Rock Diaz, American Airlines Passenger, Impersonates Soldier to Get into First Class

The New York Post reports that the Long Island man, who boarded the American Airline's plane in fatigues, dog tags and a military cap, was offered a spot in first class by a stewardess who had concluded logically, if wrongfully, that he was a soldier.
Diaz's ruse was only discovered when he landed and a customs officer asked him his rank. Diaz told him he was "E-5," which is a pay grade, not a rank. Diaz's dog tags apparently said "U.S.A. Marines Corp" and he was wearing patches in all the wrong places.
Diaz told the Post that he had not asked to be upgraded, only followed a flight attendant's instructions, an argument significantly undermined by pictures taken in 2009 showing him wearing a similar outfit while hanging out in an airline cockpit.
He was charged with second-degree impersonation, a felony under New York Law. To be charged with first-degree impersonation, Diaz would have had to pretend to be a law enforcement official or a physician.
Many airlines have standing policies - both official and unofficial - to bump soldiers up when there are empty first class seats. Thanks to a recent furor that erupted when Delta charged a group of servicemen $2,800 to carry extra baggage, soldiers are given a greater luggage allowance on most airlines as well.
Any debate surrounding the perks that soldiers deserve or that airlines graciously hand out is certainly undermined by impostors like Diaz. We here at Aol Travel are wagging our fingers so hard we're probably going to pull something.

The 4 people that commented on my post know nothing about me. I think it is pathetic that people want to judge someone by their occupation. I have more class in my finger than these 4 will ever have in their pathetic lives. Your comments show what a bunch of clowns you really are. I agree with most of you. Since all servicemen must carry their official
Military ID with them at all times, it should be no problem for a serviceman/
servicewoman to produce their ID when requested. Our military people should
not lose perks over such a simple thing. This should never have become a
problem to begin with.
here's a thought people. when the soldiers get more on the same airplane civilians get less. frankly i discourage people from joining the military as these days soldiers are governmental puppets more than freedom fighters. I won't say there is never a need to defend ourselves from other governments or devalue the courage of the soldiers though i believe it misguided. However to say impersonation of military in a civilian venue should be punishable by hanging or military jail is a mockery to the constitution of America which btw the government who manipulates those soldiers and in fact us civilians as well has shot to hell and back. I REALLY HATE to sound like a 9/11 conspiracy theorist but the more i look it up the more it looks like something is hidden there too. I genuinely wonder if there is a real reason for us to be fighting either of those wars. I won't claim this guy isn't a deceptive piece of scum since it certainly appears he is. However i fail to see why soldiers should get special treatment when anyone who can't fit well into a tiny seat is required to buy another ticket or cancel their flight with no refund. I'm aware they risk their lives when dispatched but i sure hope they don't think they are fighting for me. I'm sure you all think i'm horribly unpatriotic now. Frankly i should inform you that if we are ever invaded without a hell of a good reason ill be the guy fighting brick, tooth, and nail against the invaders even after mortally wounded. Frankly i would probably have to , or give up since they have such strong gun legislation. I would say however i am impressed by senior soldier giving up their upgrade for a lower rank. I salute you bshpfoster and spikeritz. Maybe i'm not enlisted but at the very least I still consider myself a modern day millitiaman

I asked him a few questions and of course he was clueless. I "suggested" he remove that silver star and leave. He did. If you want the prestige of being a servicman, then go serve.

He does not deserve to be punished, he does not deserve jail time, he does not deserve any hate. All he did was wear a uniform, and someone felt the need to reward him because they thought he was a soldier. It's not that I don't like soldiers, I just think of them as people who happened to choose that as a career, I don't put hold them any higher than anyone else and to think that it is a crime for him to impersonate a soldier is ridiculous.
